FOUST FLOODPLAIN DEVELOPMENT PERMIT APPLICATION
Confluence Consulting, on behalf of Foust Land Limited Partnership, has applied for a floodplain development permit to create shallow ponds and wetland areas for the purpose of increasing shore bird and waterfowl habitat within the 100-year floodplain of Flathead River. The proposal will include cuts and fills, temporary driving surfaces, irrigation, bank restoration, weir installation, removal of an existing culvert, and the installation of a hardened driving surface. The total proposed excavation for the project is approx. 19,267 cubic yards; however the majority of the excavated material will be used as natural fill on the property. Non-natural fill associated with the project will total approx. 855 cubic yards. The proposal spans over three lots and is legally described as W2NW4 of Government Lot 2 within Section 30 of T19N, R21W, a portion of the N2 of Section 30, T19N, R21W, and the S2 of S30, T19N, R21W, less Foust Subdivision.

SPRUNK CONDITIONAL USE REQUEST
Jeff Gallatin of Gallatin Construction, on behalf of Eric and Blair Sprunk, is requesting a conditional use approval within the Finley Point Zoning District, Sub-District D, Finley Point Lakeshore, to allow for impervious surface coverage exceeding 15,000 square feet. The 3.99-acre parcel is currently developed with a single family residential structure including patios and decks, a guest house, a boat house and boat rails, and landscaping. The subject property is located at 31971 S. Finley Point Road, Polson, MT, and is legally described as Lot 5, of Block 4, of Pollard Villa Site, a subdivision located within Section 18, T23N, and R19W.

ANDERSON VARIANCE REQUEST
Carstens and Associates on behalf of Sue Anderson for properties owned by Montana DNRC, is requesting a variance to allow for a non-lake related use within the 50-foot vegetative buffer in order to replace an existing holding tank on one lot, and install a new holding tank on an adjacent lot where no septic infrastructure had previously existed. The subject properties are located at 25065 and 25069 Everlasting Lane, Polson, MT and are legally described as Blue Bay Lease Lots 5 & 6, located within Section 16, T24N, and R19W.

AMENDMENTS TO LAKE MARY RONAN ZONING MAP AND REGULATIONS
Lake County is proposing a zoning map and text amendment to the Lake Mary Ronan Zoning District and Regulations. Map amendments include making corrections in Sections 11, 13, 15, and 22 within the zoning map boundaries to reflect the original public notice that created the district. Text amendments to the regulations include various updates, clarifications and typographical corrections, as well as correcting the district and sub-district descriptions; adding language addressing land outside the district that is added to parcels or lots within the district, short term rentals, accessory dwelling units (ADUs), temporary dwellings, a 50-foot vegetative buffer, stormwater management, additional public health and safety standards, and disturbance of slopes greater than 25% as a conditional use; as well as updating the purpose, the mandatory review requirements, the administrative and enforcement procedures, the definition section, and how impervious surfaces and average building heights are calculated. The subject area impacted by the proposed amendments includes all areas within the Lake Mary Ronan Zoning District.

Map amendments include making corrections in Sections 13 and 14 within the zoning map boundaries. Text amendments to the regulations include various updates, clarifications and typographical corrections, as well as correcting the district and sub-district descriptions; adding language addressing land outside the district that is added to parcels or lots within the district, accessory dwelling units (ADUs), temporary dwellings, a 50-foot vegetative buffer, stormwater management, additional public health and safety standards, and disturbance of slopes greater than 25% as a conditional use; as well as updating the purpose, the mandatory review requirements, the administrative and enforcement procedures, the definition section, how short term rentals are addressed by Lake County, how impervious surfaces and maximum average building heights are calculated, and setbacks to waterways. The subject area impacted by the proposed amendments includes all areas within the Swan Sites Zoning District.
