On Tuesday, July 24th, 2018 at 1:30 pm, the Board of Lake County Commissioners will hold a public hearing in the Office of the Lake County Commissioners, Room 211of the Lake County Courthouse on the following item:

BLAKE-GIBSON LAKE PROPERTY TRUST VARIANCE REQUEST

Anna Gibson is requesting an after-the-fact variance for reconstruction of a nonconforming dry lake-related storage building within 15 feet of the eastern property line. The Montana Twentieth Judicial District Court has ordered the Board of Lake County Commissioners to review this request per Cause No. DV-18-130 and provided by MCA 76-2-227(1)(d). This request was originally deemed denied following the February 14, 2018 and May 9, 2018 meetings of the Lake County Board of Adjustment and is now being appealed to a Court of Record as allowed by the Finley Point Zoning District and Regulations. The +/-1.5 acre lot is located at 32502 Skidoo Lane within the Finley Point Zoning District, and is legally described as Lot 4 of Skidoo Villa, located in S21 of T 23N, R 19W.

RYS-SIKORA BUILDINGS FOR LEASE OR RENT

Adam Rys-Sikora is requesting approval of a Building for Lease or Rent proposal to renovate an existing church structure and changing the use to an apartment complex with ten (10) one-bedroom apartments. The apartment structure will be supplied water by existing onsite wells and is connected to the Arlee Sewer District. VINCENT CONDITIONAL USE REQUEST

Carstens and Associates, on behalf of John & Brenda Vincent, is requesting a conditional use to construct a guest house onto an existing shop. The guest house will be temporarily designated as the primary residence during construction of a new home. Upon completion of the new home, the living quarters within the shop would be redesigned as a guest house. A guest house within the Masumola Zoning District requires conditional use approval. The 2.49-acre property is located at 32251 Rocky Point Road within the Masumola Zoning District, and is legally described as a Tract 2 of COS 6418, located in Section 16 of T23N and R20W.

SPRUNK CONDITIONAL USE REQUESTS


Jeff Gallatin of Gallatin Construction, on behalf of Eric and Blair Sprunk, is requesting conditional use approvals within the Finley Point Zoning District, Sub-district C, Skidoo Lane, to allow for the construction of a guest house with more than 1,000 square feet of living space, as well as impervious surface coverage exceeding 15,000 square feet. The 3.99-acre parcel is currently developed with a single family residential structure including patios and decks, a boat house and boat rails, and landscaping. The subject property is located at 31971 South Finley Point Road, Polson, MT 59860, and is legally described as Lot 5, of Block 4, of Pollard Villa Site, a subdivision located within Section 18, T23N, and R19W.

HATFIELD CONDITIONAL USE REQUEST

Charles Hatfield is requesting conditional use approval within the Finley Point Zoning District, Sub-District E, to allow for a temporary dwelling to be used for a construction period not to exceed 2 calendar years. The 4.85-acre parcel is undeveloped, but has approval to construct a single family residence. The conditional use approval would allow the applicant to continue using an existing 5th wheel travel trailer (RV) as a temporary dwelling during construction of an approved single family residential structure. The subject property is located at 33050 South Finley Point Road, Polson MT, 59860 and is legally described as Lot A of the of the Amended Plat of Clifford Beach Orchard Homes Subdivision, located in Section 19 of T23N, R19W.

SILVA & ROUSSEAU CONDITIONAL USE REQUEST

Lise Anne Rousseau is requesting conditional use approval within the Finley Point Zoning District, Sub-Unit E, to allow industrial uses for fruit processing and natural food products. The conditional use request is in connection with the installation of a prebuilt kitchen/processing structure (approx. 10 feet x 20 feet). The 14.80-acre property is located at 34126 South Finley Point Road and is legally described as a portion of the SE ¼ of Section 20, T23N, R19W and further described as Tract B on Certificate of Survey (COS) 4973.

HB AG INVESTMENTS VARIANCES

Altius Design Group, LLC on behalf of HB AG Investments, LLC is requesting variances to the Finley Point Zoning Regulations for reconstruction of a boathouse within the 50-foot vegetative buffer strip adjacent to Flathead Lake. Boathouses may be located within this strip if the development meets the standards of Lake County’s Lakeshore Protection Regulations. The proposed boathouse would exceed the 12-foot average height limit and be located within the 15-foot side property line setback for boathouses, which requires two variances. The 4.51-acre property is located at 30203 Festou Lane and is legally described at Lot 4 of Block 12 of Festou Villa Site, S10, T23 N, R19W.

The Planning Board will continue their discussion on adopting a Right to Farm Policy, review draft language, and suggested changes. The Board will hear any additional public comments regarding the draft Right to Farm Policy, review the changes Planning Staff has made to the draft Policy document based on comments received from the Board and public, and make a recommendation to the Lake County Board of Commissioners regarding adoption of the Right to Farm Policy.

RESOLUTION TO ADOPT 2018 LAKE COUNTY GROWTH POLICY

On Monday, July 9th, 2018, the Lake County Board of Commissioners passed a resolution of intention to adopt the proposed 2018 Lake County Growth Policy. Upon being adopted, the 2018 Growth Policy would replace the existing 2003 Lake County Growth Policy and the 1993 Polson Master Plan for their respective jurisdictional areas. The proposed Growth Policy would be used as an advisory document for land use, capital improvements planning, infrastructure, and development in Lake County. The Board of Lake County Commissioners will now hold a public hearing to consider public comments received and adoption of the proposed 2018 Growth Policy.

The proposed growth policy information is available at the Planning Dept, Rm 315 of the Lake County Courthouse. The Board of Commissioners will receive written and verbal comments up to the date of the scheduled public hearing.
